The New Jersey Department of Environmental Protection (NJDEP) has adopted several program rules to adjust the fees for various submissions to the Site Remediation Program (SRP). Specifically the fees under the UST, ISRA and Oversight rules are all being increased. The goal of the fees increase is to ensure that the amount charged covers the Department’s costs to provide the service to the regulated community. The effective date for the increased fees is October 1, 2007. The site remediation fees have not been reviewed and updated by the Department for eight years and in many cases the newly adopted fees have been increased by 50 percent. The new fees for the review of Preliminary Assessment ($375) and Site Investigation Reports ($750) will also be applicable to reports submitted by daycare and educational facilities as part of their new or renewal licensing requirements. In addition, SRP now requires persons conducting remediation of non-regulated underground storage tanks (usually residential heating oil tanks) to pay a fixed oversight fee of $400 for the review of homeowner underground storage tank remedial action reports rather than being billed using the oversight cost formula. However, in the event that the Department’s actual oversight cost exceeds three times the fixed fee the party will then be billed using the oversight cost formula.
